Criminal Code Act (1-LCC)
This act establishes the Lilaris Criminal Code (1-LCC) as the official legal framework for defining and prosecuting criminal offenses within The Second Lilaris Empire. It categorizes offenses, prescribes penalties, and outlines enforcement mechanisms to uphold law and order.
Section 1: Title
This act shall be known as the Criminal Code Act.
Section 2: Purpose
The purpose of this act is to:
- Define criminal conduct within The Second Lilaris Empire.
- Establish uniform legal standards for the prosecution and sentencing of offenses.
- Ensure due process and consistency in legal enforcement.
- Provide for national security protections and public safety.
Section 3: Definitions
For the purposes of this act, unless the context otherwise requires:
- Criminal Offense – Any act or omission that violates the Lilaris Criminal Code and is punishable by law.
- Felony – A serious offense punishable by significant penalties, including imprisonment, asset forfeiture, or exile.
- Misdemeanor – A lesser offense punishable by fines, short-term detention, or community service.
- National Security Crime – Any offense that directly threatens the sovereignty, stability, or safety of The Second Lilaris Empire.
- Unlawful Assembly – A gathering of individuals for the purpose of engaging in conduct that disturbs public order or breaches peace.
Section 4: Criminal Offenses
4.1 – Offenses Against the Person
4.1.1 – Homicide
- Murder (1-LCC § 4.1.1.1) – The unlawful and intentional killing of another with malice aforethought.
- Manslaughter (1-LCC § 4.1.1.2) – The unlawful killing of another without malice aforethought, including negligent or reckless homicide.
4.1.2 – Assault and Battery
- Assault (1-LCC § 4.1.2.1) – Any act that places another in imminent apprehension of bodily harm.
- Battery (1-LCC § 4.1.2.2) – The unlawful and intentional infliction of bodily harm upon another.
4.1.3 – Kidnapping and Unlawful Detention (New Addition)
- Kidnapping (1-LCC § 4.1.3.1) – The unlawful abduction, confinement, or restraint of another without their consent.
- Unlawful Detention (1-LCC § 4.1.3.2) – The illegal confinement or restraint of another without legal justification.
4.2 – Offenses Against Property
4.2.1 – Theft and Robbery
- Theft (1-LCC § 4.2.1.1) – The unlawful taking of property belonging to another with intent to permanently deprive the owner.
- Robbery (1-LCC § 4.2.1.2) – Theft committed with force, intimidation, or threat of harm.
4.2.2 – Burglary and Trespass
- Burglary (1-LCC § 4.2.2.1) – Unlawfully entering a structure with intent to commit theft or any other crime.
- Trespass (1-LCC § 4.2.2.2) – Unlawfully entering or remaining on another’s property after being instructed to leave.
4.2.3 – Arson and Criminal Mischief
- Arson (1-LCC § 4.2.3.1) – The intentional and unlawful destruction of property by fire or explosion.
- Criminal Mischief (1-LCC § 4.2.3.2) – Vandalism, unauthorized detonations, or other acts that damage or deface property.
4.3 – Offenses Against Public Order
4.3.1 – Disorderly Conduct
- Public Disturbance (1-LCC § 4.3.1.1) – Acts that disrupt public peace or safety, including excessive noise, riotous behavior, and incitement to violence.
- Unlawful Assembly (1-LCC § 4.3.1.2) – The gathering of three or more persons with intent to engage in conduct that breaches the peace.
4.3.2 – Aviation Regulations (Adjusting for Simplicity)
- Unauthorized Flight in Restricted Airspace (1-LCC § 4.3.2.1) – Flying aerial vehicles within federally restricted zones without approval.
- Unlawful Landing (1-LCC § 4.3.2.2) – Parking aerial vehicles outside designated landing zones as defined by jurisdictional authorities.
4.4 – National Security Crimes
4.4.1 – Espionage and Treason
- Espionage (1-LCC § 4.4.1.1) – The act of obtaining, transmitting, or disclosing classified information to foreign entities or individuals with the intent to harm the Empire.
- Treason (1-LCC § 4.4.1.2) – The act of betraying The Second Lilaris Empire by aiding enemies or engaging in actions that severely undermine national security.
4.4.2 – Unauthorized Disclosure of Classified Information
- Unauthorized Disclosure (1-LCC § 4.4.2.1) – Revealing classified government or military information without proper authorization.
Section 5: Enforcement & Sentencing
5.1 – Criminal Classification & Penalties
- Felonies – High crimes punishable by imprisonment, exile, or asset forfeiture.
- Misdemeanors – Lesser offenses punishable by fines, short-term detention, or community service.
5.2 – Sentencing Guidelines
- Sentences must be proportionate to the offense, considering mitigating and aggravating factors.
- The Lilaris Judicial System has discretion in determining appropriate penalties based on established precedent.
5.3 – Extradition & Jurisdiction
- Offenders may be extradited if they flee to foreign jurisdictions, subject to treaties or diplomatic agreements.
- The Second Lilaris Empire claims jurisdiction over crimes committed within its territory or against its citizens abroad.
